Western Australia is taking a stand against unethical practices in the towing industry with a series of new laws coming into effect. These regulations aim to protect consumers from predatory behavior and ensure a safer, more transparent towing service.
The Problem and Solution
A 2022 report revealed that a staggering 85% of consumers had encountered 'bad behavior' from tow truck operators, including intimidation, excessive fees, and illegal driving practices. The government's response has been two-pronged, with the first phase targeting behavior at crash sites and the second phase, effective today, focusing on towing business operators.
Phase Two: Regulating Business Operators
From today, towing businesses must apply for authorization to provide crash towing services. This process involves a thorough background check, with certain criminal convictions, such as firearms and drug offenses, rendering applicants ineligible. The Department of Transport and Major Infrastructure's Acting Director, Michelle Porter, emphasizes the need for 'good character, honesty, and integrity' among authorized operators.
Businesses in Perth and Peel have until September 1st to obtain their registrations, with extended deadlines for the South-West and other regions. The Department has been proactive in engaging with industry players, visiting over 70 businesses to ensure awareness of the new regulations.
Consumer Protection and Transparency
To help consumers identify authorized operators, the Department has introduced 'authority to tow' forms, which must be used by all businesses offering crash towing services post-September 1st. Additionally, authorized businesses will display their authorization details at their premises.
The Department is also tightening rules around storage yards, ensuring they meet safety and security standards, and providing consumers with clear information about where their vehicles are being stored. This addresses concerns about vehicles being moved to unsafe locations without the owner's knowledge.
Fee Increases and Regional Considerations
Maximum fees for crash towing and storage will increase slightly, in line with the Consumer Price Index (CPI). However, the Department acknowledges the unique challenges of regional WA, with its vast distances and higher business costs. While there are currently no fee caps for regional crash towing charges, businesses are still expected to charge reasonable amounts.

The current tranche of laws does not address issues like secondary tows and release fees, but these are on the Department's radar for future reforms. Ms. Porter highlights the ongoing nature of the reforms, with a focus on addressing emerging behaviors in an industry that has previously lacked regulation.
